    Welcome to Mithila Gems. These terms explain the conditions for using our website and ordering our makhana, tea and related business services.

    1. About These Terms

    These Terms & Conditions govern your use of https://mithilagems.in/ and purchases, enquiries and services provided by Mithila Gems (“we”, “us” or “our”). Our products and services include makhana, tea, bulk supply, wholesale, sourcing, private-label and export arrangements.

    Please read these terms before placing an order or confirming a quotation. When you place an order or enter into an agreed commercial arrangement with us, these terms apply together with the product details and transaction terms provided to you. Nothing in these terms limits rights or remedies that cannot lawfully be excluded.

    2. Eligibility and Customer Information

    You must be at least 18 years old and legally able to enter into a contract to place an order. If you act for a business, you must have authority to commit that business.

    Provide accurate contact, billing, delivery and business information, including GST details where relevant. Tell us promptly about any correction. Keep any account credentials secure and do not place false, fraudulent or unauthorised orders.

    3. Products, Descriptions and Availability

    Check the product description, pack size, quantity, ingredients, grade and any specifications before ordering. Availability can change, and some products or quantities may require confirmation by our team.

    Makhana and tea are agricultural products. Natural differences in size, colour, aroma and appearance may occur between batches. Such variation does not excuse a failure to meet an expressly agreed grade, specification or applicable quality requirement.

    Images illustrate products and packaging; packaging may be updated. We will seek your agreement before making a material substitution to a confirmed order.

    4. Prices, Taxes and Quotations

    Website prices apply to the product and quantity shown. Review the total and any disclosed tax, shipping or other charges before submitting an order. We will communicate charges that require a separate quotation before you confirm the transaction.

    Bulk, wholesale, private-label and export prices depend on requirements such as grade, volume, packaging, destination and freight. A quotation is valid for the period stated in it; if no period is stated, please confirm availability and pricing before accepting.

    If a material pricing or listing error affects an order, we will contact you to explain the correction and give you the option to proceed at the corrected price or cancel for a refund of amounts paid for the affected order.

    5. Orders and Confirmation

    An order submission, enquiry or automated acknowledgement confirms that we have received your request. Order fulfilment remains subject to stock availability, serviceability and confirmation of the relevant payment or agreed payment terms.

    We may contact you by email, phone or WhatsApp to confirm quantities, address, payment or dispatch details. Please use your order reference when contacting us.

    If we cannot fulfil an order, we will notify you and refund any payment received for the unfulfilled portion. Any proposed alternative requires your agreement.

    6. Payments

    Use only the payment options made available at checkout or confirmed through our official communication channels. Cash on delivery, where offered, is payable when the order is delivered. Other arrangements, including advance payments for business orders, must be agreed before processing.

    An online payment is confirmed only after successful verification. If your account is debited but confirmation is missing, contact us with the transaction reference before paying again.

    Never share a card CVV, UPI PIN, one-time password or banking password with us. Third-party payment services may also apply their own terms.

    7. Shipping and Delivery

    Delivery serviceability, shipping charges and estimated dispatch or delivery timing will be shown where available or communicated during order confirmation. For bulk or export shipments, transport arrangements must be agreed in writing.

    Provide a complete delivery address and an accessible contact number. If a shipment cannot be delivered because of incorrect details or missed delivery attempts, we will contact you to arrange the next step and disclose any proposed redelivery cost before proceeding.

    If a shipment is delayed or lost, contact us so we can investigate with the delivery partner and arrange an appropriate remedy. Delivery estimates do not remove any cancellation, return or refund rights available under applicable law.

    8. Cancellations and Order Changes

    Contact us as soon as possible if you wish to cancel or change an order. We will confirm whether the request can be processed, considering whether packing, dispatch or agreed custom production has started.

    For private-label, customised or made-to-order business supplies, cancellation and changes depend on the written terms accepted before production, including any agreed treatment of materials or work already undertaken. These arrangements remain subject to applicable law.

    If we cancel an order we cannot fulfil, we will notify you and refund amounts paid for the cancelled portion. Any cancellation charges must be disclosed and permitted by applicable law.

    9. Returns, Replacements and Refunds

    Contact us promptly if goods arrive damaged, defective, expired, incorrect, short in quantity or materially different from the agreed description. Provide your order reference, a description of the issue and, where reasonably available, photographs of the goods and packaging. Do not consume products that appear unsafe.

    We will assess the issue and arrange the return, replacement or refund required by applicable law and the circumstances of your order. This includes applicable remedies for delivery later than the stated schedule. Contact us before sending goods back so that we can provide return instructions.

    Food safety and hygiene may restrict change-of-mind returns of opened or used food products. This does not remove rights relating to defective, unsafe, incorrect or misdescribed goods. Any additional product-specific return conditions will be communicated before purchase.

    For a return caused by an error or defect attributable to us, we will arrange collection or cover reasonable return shipping agreed with you. Any cost for an optional change-of-mind return will be communicated before you proceed.

    Accepted refunds will be processed within the period required by applicable law or otherwise within a reasonable period. We will communicate the expected processing time and refund method; the payment provider may require additional time to credit your account.

    10. Food Safety, Storage and Product Use

    Read the product label for ingredients, allergen information, preparation instructions, storage conditions and best-before or use-by dates. Follow the stated instructions and store products appropriately after delivery and opening.

    If you have an allergy or need a particular ingredient specification, contact us before purchase. Product information is not a substitute for individual medical advice, and our food products are not offered as a treatment or cure for disease.

    Business buyers must maintain appropriate storage, handling, traceability and labelling practices when reselling or processing products.

    11. Wholesale, B2B and Bulk Supply

    A bulk enquiry is a request for information or a quotation and does not reserve stock. Minimum quantities, grades, tolerances, packaging, samples, payment schedules, delivery arrangements and inspection requirements must be confirmed for the transaction.

    Transaction-specific terms expressly agreed in writing form part of the business contract and govern the relevant commercial details if they differ from these general terms, subject to mandatory law.

    Samples are supplied on the basis agreed with you. Confirm any required sample approval or specification before placing a production or bulk order.

    12. Private Label and Custom Packaging

    Private-label and OEM work requires agreement on specifications, artwork, packaging, quantities, approvals, pricing and lead times. Review and approve artwork and packaging details before authorising production.

    You must have the right to use any brand name, logo, artwork or material supplied to us. Responsibilities for label declarations, destination-market requirements and product approvals must be agreed in writing before production.

    Material changes after approval may affect cost and timing. We will communicate revised terms for your agreement before carrying out those changes.

    13. Export and International Orders

    Export orders require a separate written confirmation of currency, payment terms, product specifications, documents, freight, insurance, delivery terms and the allocation of responsibilities for customs clearance, duties and taxes.

    Buyers should identify destination-country requirements before confirming an order. We will agree which party is responsible for licences, permits, registrations, testing and import documentation. Any Incoterms rule applies only if its rule and version are expressly agreed.

    Customs or regulatory delays will be addressed with the relevant parties. These terms do not transfer an agreed responsibility or remove remedies available under applicable law.

    14. Acceptable Website Use and Intellectual Property

    Use the website lawfully. Do not attempt unauthorised access, interfere with its operation, introduce malicious software, impersonate another person or misuse enquiry forms and customer information.

    Website text, photographs, logos and other materials belong to Mithila Gems or their respective owners. You may view them for personal use or genuine purchasing enquiries. Reproduction or commercial reuse requires permission unless permitted by law.

    We may restrict access where reasonably necessary to address fraud, security threats or unlawful activity.

    15. Privacy and Third-Party Services

    Our Privacy Policy explains how we handle information provided through orders, enquiries and website use.

    The website may link to payment services, WhatsApp, social platforms or other third-party services. Their own terms and privacy policies apply to your use of those services. We remain responsible for our own obligations to you.

    16. Service Interruptions and Responsibility

    We take reasonable care to maintain the website and provide accurate information. Maintenance, technical problems or events beyond reasonable control may interrupt website access or affect fulfilment. We will communicate material order issues and work towards an appropriate resolution.

    If an event prevents us from fulfilling an order, we will discuss revised arrangements or cancellation and any applicable refund. Nothing in these terms excludes liability for fraud, wilful misconduct or any responsibility that cannot be excluded by law.

    17. Governing Law and Disputes

    These terms are governed by applicable Indian law, subject to any mandatory protections that apply to a transaction or customer.

    Please contact us first with your order reference and concern so that we can try to resolve it. You retain the right to approach a competent consumer forum, court, regulator or other authority. No provision requires you to waive a statutory remedy.

    18. Changes to These Terms

    We may update these terms as our website, products or services change. The date at the top of this page identifies the latest update.

    Updated terms apply to subsequent orders or arrangements. They do not retrospectively change the terms of a confirmed order unless agreed with you or required by law.
